Sure, Now She Tells Us
Former Supreme Court Justice Sandra O’Connor has spoken out against judge-bashing, taking particular note of Tom DeLay’s threat post-Schiavo. Would it have been wrong for a sitting judge to comment at any point in the last, say, twenty years, on the use of the term “activist judges,” commonly used by the forces of far-right reactionaryism to deride the checks and balances system that makes American democracy function and to have lasted over 200 years? It’s often difficult to combat dog-whistle politics, but O’Connor’s statements are all the more welcome for being now so desperately needed.
